Booking Conditions


3.1 CHANGES, CANCELLATION AND BREACH OF CONTRACT BY YOU:

Transfers: If you are prevented from travelling you have the right to transfer your booking to another date or another person. However you must tell us you want to do this more than 42 days before departure. We will charge an administration/amendment fee of L30 per booking for this transfer. You will also have to pay any extra costs which are caused by the transfer, subject to our principals and partners regulations such as airlines, insurers and others. Until the holiday is paid in full for both you and the person who takes your place are responsible for payment. If you intend to do this we will advise of the costs that will be incurred prior to making any changes.

Other changes: If you wish to make any other changes to your booking we will do our best to assist but cannot give any guarantees. We will charge an amendment fee of L30 per booking for changes. You will also have to pay any extra costs which are caused by the change. Changes to your booking within 42 days of departure will be treated as a cancellation. If this is the case you will be liable to pay the charges set out in Paragraph 3. Should travel dates be amended it must be noted that certain travel arrangements (for example air travel-fixed reservations or tickets) may not be changeable after a reservation has been made and any alteration request could incur a cancellation charge of up to 100% of that part of the arrangement.

Cancellation and under-occupancy:If you wish to cancel your booking you can do so either by informing your travel agent in writing or, if you booked direct, by sending us a letter by recorded delivery. In all cases we can only accept a cancellation from the person who is the party leader. If you do cancel you will have to pay cancellation charges. The amount you pay will depend upon when you cancel. This will be the date we are informed by your travel agent or when we receive your cancellation letter.

The price of some holiday accommodation, such as villas or self contained apartments is based upon the number of people sharing the accommodation. If you have booked such accommodation and members of your party cancel their booking, they will be required to pay the cancellation charges set out below. In addition the remaining members of the party may be charged a supplement to cover the cost of the under occupancy of the accommodation. Please note that this supplement is not a cancellation charge and is not covered by our insurance policy.

It is important to note that in some cases carriers (airlines) levy a 100% cancellation charge and all details will be advised at time of cancellation.

Insurance claims: If you cancel for any reason please check that whether you are covered by the insurance policy and if you are entitled, to make a claim.

3.2 CHANGES, CANCELLATION AND BREACH OF CONTRACT BY US:

(a) If we change youre booking before departure: If we have to make a major change to your holiday before departure we will inform you as soon as possible. Examples of major changes include change of airport, change of your departure or return time by more than 23 hours, change of your resort, and change of your hotel to one with a lower official classification. In such circumstances you can either cancel arrangements without penalty or accept the change with a variation in the price to take account of the change. Except where the change was caused by unusual and unforeseeable events over which we had no control and which we could not have avoided, even if we had taken all reasonable care, you will be entitled to compensation on the scale set out in Paragraph 3 (b). Such unusual and unforeseeable events include war, civil unrest, industrial disputes, terrorist activities, natural or nuclear disasters, fire and adverse weather conditions.

(b) If you cancel because of major changes or we cancel your holiday: If you decide to cancel your contract with us because we have made a major change to it, or if we cancel the holiday, then we will offer you an alternative holiday of equivalent value, if we have one available, or, on payment of the price difference, an alternative holiday of lower value, if we have one available and a refund of the price difference, or a full refund of all the money you have paid for the holiday, except for insurance premiums.

You will be entitled to a compensation payment on the scale below, unless we cancel the holiday because of unusual and unforeseeable events which were beyond our control and which we could not have avoided even if we had taken all reasonable care, or there were too few people booking the holiday.

(c) Other breaches of contract by us: If we breach our contract with you in any other way we will pay appropriate compensation if this has affected the enjoyment of your holiday save that we will not be liable to you for damage caused by any failure to perform our contract or improper performance if it is attributable to:

Your own fault or that of any member of your party

A third party unconnected with the holiday services we have contracted to provide you with and which is unforeseeable or unavoidable; or

Unusual or unforeseeable circumstances beyond our control which could not have been avoidable even if all reasonable care had been taken

Events which neither we nor our suppliers could have foreseen or forestalled, even if we had taken all reasonable care.

Our liability will not exceed the lower of (a) any limitation applicable under any international convention governing or relating to a breach of the service complained of and (b) except in the case of personal injury, one quarter of the price of the holiday of the person making the claim against us.

International carriage and limitation of liability in cases of non personal injury We limited our liability, in cases of carriage by air, as far if we were carriers under the Warsaw Convention of 1929 on Carriage by Air as amended by the Hague Protocol of 1955, and, in cases of carriage by sea, as if we were carriers under the Athens Convention of 1974 on Carriage by Sea.

(d) Changes after departure: If we have to make major changes to your holiday after you have departed we will make suitable alternative arrangements for you to continue your holiday, at no extra cost. If it is impossible to make alternative arrangements or you have good reasons for refusing them we will make every effort to transport you back to your point of departure or to another place, if you agree to it. This is in addition to any rights you may have to compensation.

(e) Flight delay protection: If your flight is delayed it is the responsibility of the airline you are travelling with to provide you with refreshment, food and accommodation, at their discretion. For prolonged delays, you may be entitled to make a claim under your insurance policy.
